REPORT OF THE FOURTH MEETING OF THE CONFERENCE OF THE PARTIES TO THE VIENNA CONVENTION FOR THE PROTECTION OF THE OZONE LAYER

INTRODUCTION

1. The fourth meeting of the Conference of the Parties to the Vienna Convention for the Protection of the Ozone Layer was held at the Herradura International Conference Centre, San José, on 25 and 27 November 1996.

I. OPENING OF THE MEETING

2. The meeting was opened by Mr. Virah Mavichak of the Ministry of Industry of Thailand, President of the Conference at its third meeting, at 10a.m. on 25 November 1996.

A. Statement by the President of the Conference of the Parties at its third meeting

3. In his opening remarks, the President of the Conference of the Parties at its third meeting thanked the Government of Costa Rica for hosting the fourth meeting of the Conference and expressed his gratitude to all participants for the support extended to himself and the other members of the Bureau since the third meeting. Many important developments had taken place since that meeting, including new ratifications of the Convention, bringing the total number of Parties to 162, which reflected the world-wide concern for protecting the ozone layer. Noting the importance of scientific research to the success of the Vienna Convention and Montreal Protocol, he recalled the Third Meeting of the Ozone Research Managers held earlier in the year and drew attention to the recommendations contained in their report. The Bureau had endorsed those recommendations and he called on the Parties to support them. He appealed to the Global Environment Facility (GEF) to assist in efforts to safeguard the ozone layer by contributing funds to support ozone monitoring, training and targeted research in developing countries. Drawing attention to the proposed budgets for the Trust Fund for the Vienna Convention, he appealed to all Parties to pay their contributions in full and on time.

B. Statement by the representative of the Government of Costa Rica

4. The statement of His Excellency Mr. José Maria Figueres, President of Costa Rica, to the Eighth Meeting of the Parties to the Montreal Protocol, as reflected in the report of that Meeting (UNEP/OzL.Pro.8/..), applies mutatis mutandis to the fourth meeting of the Conference of the Parties to the Vienna Convention.

C. Statement by the Executive Director of the UnitedNations Environment Programme (UNEP)

5. The statement of Ms. Elizabeth Dowdeswell, Executive Director of the UnitedNations Environment Programme (UNEP) to the Eighth Meeting of the Parties to the Montreal Protocol, as reflected in the report of that Meeting (UNEP/OzL.Pro.8/..), applies mutatis mutandis to the fourth meeting of the Conference of the Parties to the Vienna Convention.

D. Statement by the Secretary-General of the World Meteorological Organization (WMO)

6.Mr. R. D. Bojkov, speaking on behalf of the Secretary General informed the meeting that, during the current 1996 season, ozone content over the Southern Polar region was already the lowest ever recorded. Emphasizing the importance of continuous scientific monitoring of the ozone layer and UV radiation to the success of the Vienna Convention and Montreal Protocol, he outlined WMO activities in that area and called for an improvement in national and international capabilities in atmospheric monitoring and related research activities.

II. ORGANIZATIONAL MATTERS

A. Attendance

C. Adoption of the agenda

11. At its opening session, the Conference adopted the following agenda, as contained in documentUNEP/OzL.Conv.4/1:

  1. Opening of the meeting:

      (a)Opening remarks by the President of the Conference of the Parties at its third meeting;

      (b)Statement by the representative of the Government of CostaRica;

      (c)Statement by the Executive Director of the United Nations Environment Programme (UNEP);

      (d)Statement by the Secretary-General of the World Meteorological Organization (WMO).

  2. Organizational matters:

      (a)Election of the President, three Vice-Presidents and the Rapporteur;

      (b)Adoption of the agenda;

      (c)Organization of work;

      (d)Credentials of representatives.

  3. Consideration of the recommendations of the Preparatory Meeting and decisions on increased funding for the Global Ozone Observing System (GO3OS) in developing countries and financial report for 1994-1995 and the proposed budgets for the Vienna Convention Trust Fund for the years 1997, 1998, 1999 and 2000 and other issues.

  4. Date and venue of the fifth meeting of the Conference of the Parties.

  5. Other matters.

  6. Adoption of the report.

  7. Closure of the meeting.

D. Credentials

12. The Bureau of the fourth meeting of the Conference of the Parties to the Vienna Convention approved the credentials of the representatives of 81 Parties to the fourth meeting of the Conference of the Parties to the Vienna Convention out of 107 Parties representated at the meeting. The Bureau also approved provisionally the representation of 7 Parties, on the understanding that they would send the credentials to the Secretariat in due course.

III. SUBSTANTIVE MATTERS

A. Action by the Conference

13. Under agenda items 3,4 and 5, the Conference had before it the report of the Executive Director (UNEP/OzL.Conv.4/2), draft decisions circulated earlier by the Secretariat (UNEP/OzL.Conv.4/5), the financial reports on the Trust Fund for the Vienna Convention for the first year of the biennium 1994-1995 (UNEP/OzL.Conv.4/3), the approved 1996 and proposed 1997, 1998 and 1999 budgets for the Ozone Secretariat (UNEP/OzL.Conv.4/4), and the report of the Preparatory Meeting along with its annex containing the draft decisions approved for consideration by the Meeting of the Parties (UNEP/OzL.Conv.4/Prep/2).

14. The Conference adopted a number of decisions on the basis of the draft decisions submitted by the Preparatory Meeting. The text of the decisions as adopted is contained in paragraph15 below. All the decisions were adopted by consensus, with the comments reflected in paragraph16 below.

IV. DECISIONS

A. Decisions adopted by the fourth meeting of the Conference of the Parties

15. The fourth meeting of the Conference of the Parties to the Vienna Convention for the Protection of the Ozone Layer decides:

Decision IV/1. Adjustments and Amendments to the Montreal Protocol

1. To note the adjustments to the Montreal Protocol that were adopted by the Seventh Meeting of Parties to the Montreal Protocol, held in Vienna from 5to 7 December 1995, and that these adjustments relating to controlled substances in Annex A and Annex B of the Montreal Protocol entered into force for all Parties on 5 August 1996 and those relating to Annex C and Annex E will enter into force for all Parties on 1 January 1997;

2. To urge all States that have not already ratified the Vienna Convention, the Montreal Protocol and its Amendments, to do so expeditiously;

Decision IV/2. Reports of the three Assessment Panels

1. To take note with appreciation of the reports of the Scientific, Environmental Effects and Technology and Economic Assessment Panels and the Technical Options Committees;

2. To acknowledge the important role played by the Scientific Assessment Panel in coordinating the report of the World Meteorological Organization (WMO) and the substantial contributions by the national agencies to the preparation of the report;

Decision IV/3. Recommendations of the Third Meeting of the Ozone Research Managers

1. To take note of the report of the Third Meeting of the Ozone Research Managers;

2. To endorse the recommendations of the Third Meeting of the Ozone Research Managers, as contained in the report of that meeting /, to the fourth meeting of the Conference of the Parties to the Vienna Convention;

3. To request all Parties:

    (a) To maintain and further develop monitoring and archiving of measurements of stratospheric and tropospheric ozone, including vertical profiles and other trace species and aerosols, and to pursue the development and implementation of new observational capacities, such as aircraft and satellite-based measurements;

    (b) To increase investigation and quantification of stratospheric and tropospheric processes through routine monitoring and experimental campaigns to understand current changes and to further develop predictions of stratospheric change both for the short and long term;

    (c) To investigate the interactions between ozone and climate and the impact of aircraft emissions;

    (d) To cooperate with the World Meteorological Organization in its continued work towards coordinated and compatible UV-B measurements and their archiving;

    (e) To enhance research on the effects of UV-B through, inter alia, establishing baseline data on biological systems and establishing the interactions with other environmental factors such as climate change;

    (f) To cooperate with the World Meteorological Organization and the United Nations Environment Programme to enhance training and baseline monitoring of ozone, UV-B radiation and related research in developing countries;

    (g) To make additional voluntary contributions to the World Meteorological Organization's Trust Fund for environmental monitoring for the Global Ozone Observing System;

Decision IV/4. Funding matters

1. To invite the Global Environment Facility (GEF) to support the monitoring of ozone and UV radiation and related research in developing countries;

2. To request the Parties to support such programmes using appropriate mechanisms;

Decision IV/5. Budget and financial matters

1. To take note of the certified and audited accounts of the Trust Fund for the Vienna Convention for the Protection of the Ozone Layer for expenditures under the Trust Fund for 1993, 1994 and 1995;

2. To take note of the financial reports on the Trust Fund for the Vienna Convention for the biennium 1992-1993 ended 31 December 1993; first year of biennium 1994-1995 as at 31 December 1994 and the biennium 1994-1995 ended 31 December 1995;

3. To request the Executive Director of UNEP to extend the duration of the Trust Fund for the Vienna Convention until 31 December 2000, subject to the approval of the UNEP Governing Council;

4. To adopt the budgets for the Trust Fund of $1,057,170 for 1996, $361,090 for 1997, $382,342 for 1998, $1,207,991 for 1999, and $370,590 for 2000, as set out in annex I to this report;

5. To urge all Parties to pay their outstanding contributions on time and in full in accordance with the terms of reference of the Trust Fund and the formula for contributions contained in annex II to this report;

6. To urge all Parties to make additional voluntary contributions amounting to US$ 200,000 annually to WMO (World Meteorological Organization), in support of its ozone monitoring activities of developing countries, in view of the fundamental importance of such monitoring activities to the Convention;

7. Request the Executive Director of UNEP to ensure that the 13 per cent programme support costs charged to the Trust Fund for the Vienna Convention are used fully in support of the Convention and its Secretariat, and to report to the next Meeting of the Conference of the Parties on the ways in which the 13 per cent has been used for the benefit of the Convention and its Secretariat.

Decision IV/6. Fifth meeting of the Conference of the Parties to the Vienna Convention for the Protection of the Ozone Layer

To convene the fifth meeting of the Conference of the Parties to the Vienna Convention in 1999 in conjunction with the Eleventh Meeting of the Parties.

A. Comments made at the time of adoption of the decisions

Decision IV/3. Recommendation of the Third Meeting of the Ozone Research Managers

16. The representative of Canada expressed full support for the recommendations contained in the Report of the Third Meeting of Ozone Research Managers. Noting that one of the recommendations in that report concerned the need for observations of atmosphere ozone and UV to be submitted in a timely manner to the World Ozone and UV Data Centre, located in Toronto, he urged all ozone and UV observing stations to comply so that that important information could be made available for the benefit of other researchers in the evaluation of trends and other studies.

V. DATE AND VENUE OF THE FIFTH MEETING

17. In accordance with Decision VI/6 of the Fourth Meeting of the Conference of the Parties to the Vienna Convention and the decision of the Bureau, the Conference agreed to hold its fifth meeting in 1999 in conjunction with the Eleventh Meeting of the Parties to the Montreal Protocol.

VI. ADOPTION OF THE REPORT

18. The report was adopted by the meeting on the basis of its draft report as contained in document UNEP/OzL.Conv.4/L.1.

VII. CLOSURE OF THE MEETING

19. After the customary exchange of courtesies, the President declared the fourth meeting of the Conference of the Parties to the Vienna Convention closed on Wednesday 27 November 1996.

Classification of the posts in UNEP is currently taking place in accordance with the guidelines of the UnitedNations. Provision is made for upgrading, if found necessary, in the classification and if approved by the Executive Director, after review.

The salaries are updated to reflect the current and estimated future salary levels in Nairobi.

The conference-servicing costs have been based on the following assumptions:

The 1999 meeting of the Conference of the Parties and its Preparatory Meeting will be held in Nairobi, using six languages.

One Bureau meeting is scheduled for 1999.

One Ozone Research Managers meeting will be held in 1999, in Geneva. In accordance with Conference decision III/6, the meeting planned for 1995 was rescheduled for 1996. Therefore, the approved budget for organizing this meeting in 1995 has been carried over to 1996.

Travel on official business has been increased to $45,000 in 1999 to cover the cost of organizing the Ozone Research Managers meeting in Geneva and the fifth meeting of the Conference of the Parties to the Vienna Convention.

The average cost of participation is assumed to be $5,000 per participant in 1997, with no more than one person's travel cost being covered for each country and using the most appropriate economical fare and United Nations per diem allowances.

The participation costs for the Bureau meeting are based on there being four participants from developing countries or countries with economies in transition.

One Ozone Research Managers meeting will be held in 1999, in Geneva. Funding is reserved for participants from developing countries. In accordance with Conference decisionIII/6, the meeting planned for 1995 was rescheduled for 1996, and, therefore, the budget approved for participation in this meeting in 1995 has been carried over to 1996.

The cost of expendable equipment has been increased marginally to cover inflation.

The level of rent has been increased to current levels from 1998 onwards.

Contingency

If the need arises, the Secretariat will request the Conference of the Parties to review the contingency.
